General Terms and Conditions of Business

General

All business dealings between Idiomspace – Translation Services, Unipessoal Lda., hereinafter referred to as Idiomspace, and its clients are governed by these General Terms and Conditions of Business. These General Terms and Conditions of Business are deemed to have been accepted by the client at the time our quotation is accepted or the order is placed.

Quotations

Our quotation for a project is generally calculated based on the number of words in the text to be translated (the source text). The charge for the project, however, also considers various other factors, such as the language pair requested, the degree of complexity of the subject matter, and the format in which the project is to be delivered. For projects of fewer than 200 words, we charge our minimum fee of €20.00.

We provide clients with quotations free of charge. Quotations must be accepted via e-mail or by post. In the event that nothing to the contrary is received in writing at the time that our quotation is approved, the client shall be deemed to have accepted Idiomspace’s General Terms and Conditions of Business.

Project

The client shall accept the quotation for the services offered by issuing a written order. Idiomspace shall accept no liability for any problems arising therefrom, however, should the order be accepted by telephone or any other informal means.

The client may submit texts in digitally editable electronic format, on paper in either typed or printed format or any other format agreed between Idiomspace and the client. Should the client require a notarised certification of the translation, the document to be translated must be the original or a certified copy thereof, and must be delivered to our offices by hand or by registered mail.

If the documents are of a technical nature, that client should provide reference documents or other information which allows a better understanding of the documents in question and a better subsequent performance of the requested service.

Requests for alterations after receipt of the client’s written order are to be made in writing and submitted to Idiomspace by post, e-mail or other appropriate method. Should requests of this nature be received after receipt of the client’s written order, Idiomspace reserves the right to adjust the price originally quoted and alter the agreed delivery date or time.

Project delivery

The project shall be delivered by the deadline stipulated and agreed and under the conditions agreed between Idiomspace and the client, circumstances arising due to force majeure notwithstanding.

The project shall be sent by e-mail, by post or any other appropriate means as agreed, and its delivery shall be deemed to have taken place at the time the project was sent to the client. Idiomspace shall accept no liability for any delay caused by companies managing postal or other services mentioned above. The client may elect to collect the documents directly from our premises.

Payment

All amounts invoiced are subject to VAT at the currently applicable rate.

Unless otherwise agreed in writing, the total amount of the invoice shall be payable, without being discounted, within thirty days of the date of its receipt by the client. Any delay in payment may result in the application of interest.

Placing an order for a service may be subject to the payment of a deposit. Should this be the case, the project shall be delivered upon payment of the full amount of the order, once notification of completion of the order has been given. If so required, the client may receive a part of the translation in order to attest to its quality prior to payment.

The cancellation of any order once work on that order has begun shall incur a 100% charge for the work already completed by the date of cancellation, while the balance of the project shall attract a fee of 50% of its quoted value.

Payment shall be made by bank transfer.

Complaints

Once the project has been delivered, the client has 5 days within which to make any complaint about the quality of the service or its delivery. Such complaints must be made in writing and include the original and final texts, highlighting those parts of the text which form the basis of the complaint. Any complaints received after 5 days from date of delivery will not be considered.

A complaint on one part of the text does not call the entirety of the text into question, and as such, shall be revised and the necessary corrections made.

In the event of loss or destruction of the documents sent to the client, the liability of Idiomspace shall be limited to the invoice value of the service provided.

The professionals at Idiomspace shall not be held liable for the use of style and/or terminology which differs to that of the client where such use fails to reveal grammatical or spelling errors and/or conforms to the reference material provided by the client.

Until payment in full by the client for the project, Idiomspace shall remain the legitimate owner of the texts created. Once the client has taken full ownership of the texts, any use, copy or reproduction of the same shall be at their sole discretion and therefore Idiomspace shall not be held liable for any claim arising therefrom in this regard.

Confidentiality

Confidentiality of documents and data delivered to Idiomspace shall remain intact. No client information shall be used for any purpose other than the exercising of the professional activity of Idiomspace, which shall not be held liable for the transfer of data by means of electronic communication.

Privacy policy

Idiomspace respects and shall maintain the privacy of all users of its website, whether clients, colleagues or visitors. User information is gathers so that requests and/or questions can be processed more easily and the services provided by Idiomspace improved.

Data collected for this purpose will not be disclosed to any third party outside of Idiomspace. Information will be handled and processed in accordance with currently applicable legislation with regard to the protection of personal data.

Any user has the right to access, update, correct or delete his or her data simply by contacting Idiomspace.
